Litigation is stressful for children and, therefore, not always in the child’s best interest. This panel presentation focuses on child-related mediations and the benefits and issues involved in using mediation as an alternative to litigation in cases involving children. The panel addresses how mediation works in a variety of child-related disputes; what value mediation can provide to clients in disputes involving children; and the roles of the child, lawyer and mediator in these different mediation processes. Discussion also includes family/divorce, delinquency, and child abuse/neglect mediation. Brian Hufford has been litigating health care class actions on behalf of providers and patients for the last decade. A material part of his practice has focused on challenges to the use of a database promulgated by Ingenix, Inc., a wholly-owned subsidiary of United Health Group, to determine "usual, customary and reasonable" rates for out-of-network (ONET) health care services. In this presentation, Mr. Hufford will discuss some of the cases he has litigated, including against Health Net (a case brought on behalf of subscribers, which settled), and United, Aetna, CIGNA and Wellpoint, where he is representing the American Medical Association and various state medical societies. Understanding how family law and immigration law issues intertwine is critical to ensuring competent representation of a client in any family law matter involving a non-U.S. citizen. Because decisions made in family law matters have serious consequences on the non-citizen’s ability to stay in the United States or obtain a permanent residency, a lawyer not familiar with basic immigration law risks malpractice. Aliens in the country legally or seeking to be admitted may be deportable or inadmissible if they are convicted of a crime involving moral turpitude. Allegations of such crimes in a petition for marital dissolution can become critical in immigration proceedings. The decision whether to adopt a minor in the U.S. or abroad can impact the approval of that child’s naturalization. Spouses and children who are dependents of a non-citizen admitted on a work visa risk losing their status if the parties divorce.
