Master Series Presented by the Illinois State Bar Association

Don’t miss this one-day only opportunity to learn advanced negotiation skills from a national expert and renowned instructor!

You negotiate every day. In fact, your ability to effectively negotiate may be the most critical skill you possess, yet most negotiate instinctively or intuitively. This Master Series seminar trains you to approach negotiations with a strategic mindset, allowing you to become a more effective lawyer. Topics include: the five golden rules of negotiation; strategies to get past “no”; gaining leverage; emotionally-charged techniques; generating creative solutions; sharing information; dealing with untrustworthy adversaries; building future relationships; deadlines and time tips; and much more.

The seminar is taught by Martin Latz, one of the nation’s leading experts and instructors on negotiating techniques. As the founder of the Latz Negotiation Institute, he has trained over 50,000 lawyers and business professionals around the world. As an adjunct professor on Negotiations at Arizona State University College of Law (1995-2005), Mr. Latz has negotiated for the White House, nationally and internationally, on the White House Advance Teams. Mr. Latz, a Harvard Law cum laude graduate, is the author of Gain the Edge! Negotiating to Get What You Want (St. Martin’s Press, 2004) and has appeared as a negotiation expert on CBS’s The Early Show and such national business shows as Your Money and First Business. He also writes a monthly negotiation column for The Arizona Republic. For more information on Mr. Latz, please visit: www.NegotiationInstitute.com

Each registrant will receive a copy of Martin Latz’s book,
Gain the Edge! Negotiating to Get What You Want.

Comments From Past Attendees:

Marty Latz is one of the most accomplished and persuasive negotiators I know. In [his book] Gain the Edge! you will see why.

George Stephanopoulos, ABC News

Practical and immediately applicable to my actual practice and the negotiations I must conduct on behalf of our corporate clients.

Bruce Rosenthal, Nixon Peabody, New York, NY

Excellent. I’m in-house counsel for a software company. I brought five contract negotiators to the course and I’m confident that this will improve both their and my negotiation skills.

Jenni Manning, Levi, Ray & Shoup, Inc., Springfield, IL

Whether you are a confident negotiator or one who is apprehensive of the process, you will learn much from [Latz’s] book. Its lucid explanations, coupled with a host of practical examples, will help you to achieve better results when you next negotiate.

Professor Frank Sander, Bussey Professor of Law, Harvard Law School

Co-Sponsored by the ISBA Family Law Section and the ISBA Alternative Dispute Resolution Section

Litigation is stressful for children and, therefore, not always in the child’s best interest. This panel presentation focuses on child-related mediations and the benefits and issues involved in using mediation as an alternative to litigation in cases involving children. The panel addresses how mediation works in a variety of child-related disputes; what value mediation can provide to clients in disputes involving children; and the roles of the child, lawyer and mediator in these different mediation processes. Discussion also includes family/divorce, delinquency, and child abuse/neglect mediation. The program is designed for attorneys who practice in domestic relations, probate, juvenile court, adoption…and any other practitioner interested in settling child-related disputes through mediation rather that litigation.

It is imperative that environmental law attorneys, real estate practitioners, and corporate legal counsel understand what vapor intrusion is, how it occurs, and the potential issues/liabilities a facility may face as a result of vapor intrusion, particularly in light of the Illinois Pollution Control Board's rulemaking that is presently underway. By the same token, even as we become better stewards of the environment and "going green" becomes more popular, there are many unexplored aspects to building a structurally "green" building.

The morning program is devoted to the exploration of vapor intrusion—with topics ranging from what vapor intrusion is to an overview of the vapor intrusion rules, from what those rules mean to the attorney to how vapor intrusion impacts the real estate transaction.

The afternoon program examines the techniques that are available for green building, including tax and insurance considerations, obtaining municipal and regulatory support for green building, and construction considerations.

Attorneys representing health care clients must keep abreast of current legal and ethical issues relating to the rapidly evolving world of electronic health records. Although the increased access to health information in the electronic health record age is a significant advance, health care providers are faced with certain legal and ethical issues that they must address.

Understanding the effects that regulated quality standards may have on your clients, including their impact on reimbursement, professional liability exposure, and contracting, is essential to anticipating and, therefore, avoiding unintentional consequences of those standards.

Health care attorneys, hospital in-house counsel, and professional liability attorneys of all levels of experience will find this program beneficial.

Brian Hufford has been litigating health care class actions on behalf of providers and patients for the last decade. A material part of his practice has focused on challenges to the use of a database promulgated by Ingenix, Inc., a wholly-owned subsidiary of United Health Group, to determine "usual, customary and reasonable" rates for out-of-network (ONET) health care services. In this presentation, Mr. Hufford will discuss some of the cases he has litigated, including against Health Net (a case brought on behalf of subscribers, which settled), and United, Aetna, CIGNA and Wellpoint, where he is representing the American Medical Association and various state medical societies. The program, designed for the intermediate attorney representing clients in the healthcare sector, will detail the legal arguments being made by plaintiffs, the primary arguments in opposition to the plaintiffs' position, and where things currently stand with regard to the use of Ingenix and the determination of ONET reimbursement.

A Look At Recent Amendments to the Federal Rules of Civil Procedure and New Federal Rule of Evidence 502
Amendments to the Federal Rules of Civil Procedure and New Federal Rule of Evidence 502 require early disclosures of information regarding client systems, compel you to specify the format of data you receive in discovery, and offer protection against inadvertent disclosure of privileged information—all of which requires planning and coordinating with your opponent from the onset of a case. In this segment, the speaker explains these rules in clear terms and offers insight on how they can both help and hurt you in an era where most of the discoverable evidence you deal with is stored in 1s and 0s—that is, the language of computers.

In recent years, a trend has emerged for law firms to move toward a more paperless environment. Experience has demonstrated that the more often paper is handled, the greater the risk for damaging, misplacing or misfiling a document becomes, which can lead to potential malpractice claims. Understanding how family law and immigration law issues intertwine is critical to ensuring competent representation of a client in any family law matter involving a non-U.S. citizen. Because decisions made in family law matters have serious consequences on the non-citizen’s ability to stay in the United States or obtain a permanent residency, a lawyer not familiar with basic immigration law risks malpractice. Aliens in the country legally or seeking to be admitted may be deportable or inadmissible if they are convicted of a crime involving moral turpitude. Allegations of such crimes in a petition for marital dissolution can become critical in immigration proceedings. The decision whether to adopt a minor in the U.S. or abroad can impact the approval of that child’s naturalization. Spouses and children who are dependents of a non-citizen admitted on a work visa risk losing their status if the parties divorce. This program explains the current state of immigration law in key areas of family law to ensure that clients are protected from the immigration consequences that may follow, and is designed for all levels of practitioner experience.
