It is imperative that environmental law attorneys, real estate practitioners, and corporate legal counsel understand what vapor intrusion is, how it occurs, and the potential issues/liabilities a facility may face as a result of vapor intrusion, particularly in light of the Illinois Pollution Control Board's rulemaking that is presently underway. By the same token, even as we become better stewards of the environment and "going green" becomes more popular, there are many unexplored aspects to building a structurally "green" building.
The morning program is devoted to the exploration of vapor intrusion—with topics ranging from what vapor intrusion is to an overview of the vapor intrusion rules, from what those rules mean to the attorney to how vapor intrusion impacts the real estate transaction.
The afternoon program examines the techniques that are available for green building, including tax and insurance considerations, obtaining municipal and regulatory support for green building, and construction considerations.

Brian Hufford has been litigating health care class actions on behalf of providers and patients for the last decade. A material part of his practice has focused on challenges to the use of a database promulgated by Ingenix, Inc., a wholly-owned subsidiary of United Health Group, to determine "usual, customary and reasonable" rates for out-of-network (ONET) health care services. In this presentation, Mr. Hufford will discuss some of the cases he has litigated, including against Health Net (a case brought on behalf of subscribers, which settled), and United, Aetna, CIGNA and Wellpoint, where he is representing the American Medical Association and various state medical societies. The program, designed for the intermediate attorney representing clients in the healthcare sector, will detail the legal arguments being made by plaintiffs, the primary arguments in opposition to the plaintiffs' position, and where things currently stand with regard to the use of Ingenix and the determination of ONET reimbursement. | Formats Available: CD-ROM (Win), Audio CD, Streaming Chairperson: Carolyn V.
